These Terms and Conditions set out the basis on which Waste Clearance Hackney provides waste collection and clearance services to domestic and commercial customers. By booking a waste collection, using our services or allowing our operatives access to your premises, you agree to be bound by these Terms and Conditions.
In these Terms and Conditions, the following words have the meanings given to them below:
Customer means the individual, business or organisation that books or receives waste clearance or collection services from Waste Clearance Hackney.
Services means any waste collection, removal, clearance, loading, transportation or related service provided by Waste Clearance Hackney.
Waste means any rubbish, junk, unwanted items or materials that the Customer instructs Waste Clearance Hackney to remove, excluding any items that are prohibited by law or specifically excluded under these Terms and Conditions.
Site means the property, premises, location or area from which Waste Clearance Hackney is instructed to remove Waste.
Waste Clearance Hackney provides on-demand waste collection and clearance services, including but not limited to household waste removal, bulky item clearance, garden waste removal and commercial waste collections. The precise scope of the Services will be as agreed at the time of booking and confirmed by Waste Clearance Hackney in a written or verbal quotation.
Services are provided subject to availability, local access conditions, safety considerations and compliance with applicable laws and waste regulations. Waste Clearance Hackney reserves the right to refuse to collect any materials that are hazardous, prohibited, unsafe to handle or otherwise not suitable for removal under these Terms and Conditions.
3.1 Bookings can be made by telephone, email or other communication channels made available by Waste Clearance Hackney from time to time. The Customer must provide accurate and complete information, including the Site address, access details, description and approximate volume or weight of Waste, and any relevant restrictions or special requirements.
3.2 Waste Clearance Hackney may provide an initial estimate or guide price based on the information provided by the Customer. All such estimates are indicative only and are subject to confirmation on arrival at the Site. Where the actual volume, weight or nature of the Waste differs from the Customer's description, Waste Clearance Hackney may revise the price accordingly.
3.3 A booking will only be considered accepted when Waste Clearance Hackney confirms the booking by telephone, email or other written communication, and provides a date or time window for the collection.
3.4 The Customer is responsible for ensuring that a person aged 18 or over is available at the Site at the agreed time to grant access, provide instructions and approve any necessary adjustments to the Service or pricing.
4.1 The Customer must ensure that Waste Clearance Hackney has safe, reasonable and lawful access to the Site, including suitable parking for our vehicle and clear routes to the Waste to be removed.
4.2 The Customer must notify Waste Clearance Hackney in advance of any access restrictions, loading limitations, parking controls, height or width restrictions, or other site-specific conditions that may affect the provision of the Services.
4.3 Where parking charges, permits or fees apply, the Customer is responsible for arranging permits or reimbursing any parking charges incurred by Waste Clearance Hackney directly as part of the Service cost.
4.4 Waste Clearance Hackney reserves the right to refuse or suspend the Service if access is unsafe, unlawful, obstructed, or if proceeding would risk damage to property, vehicles or the health and safety of operatives or third parties.
5.1 Unless otherwise stated, prices are based on factors including but not limited to the volume or weight of Waste, the type and composition of Waste, loading difficulty, access conditions, travel time, and any disposal or recycling charges.
5.2 Any quotation issued by Waste Clearance Hackney is valid only for the specific Service described and for the period stated in the quotation. If no period is stated, the quotation will be valid for 30 days from the date of issue, provided that no material change occurs in the information supplied by the Customer.
5.3 If on arrival at the Site the actual Waste or Site conditions differ from those described at the time of booking, Waste Clearance Hackney may amend the quotation. The Customer will be informed of any change to pricing before the Service proceeds. If the Customer does not accept the revised price, Waste Clearance Hackney may cancel the Service and a call-out charge may be applied to cover our costs.
6.1 Payment is due on completion of the Service unless otherwise agreed in writing prior to the booking. Waste Clearance Hackney may require full or partial payment in advance for certain types of work or for commercial accounts.
6.2 Payment may be made by accepted card, bank transfer or other payment methods offered by Waste Clearance Hackney from time to time. Cash may be accepted only where explicitly agreed, and a receipt will be issued.
6.3 For approved business customers, invoices may be issued with payment terms specified on the invoice. If no terms are specified, payment is due within 14 days of the invoice date.
6.4 If the Customer fails to pay any sum due on the due date, Waste Clearance Hackney reserves the right to charge interest on the overdue amount at the statutory rate, and to suspend or withhold further Services until full payment is received.
7.1 The Customer may cancel or reschedule a booking by notifying Waste Clearance Hackney as soon as possible by telephone or email.
7.2 If the Customer cancels more than 24 hours before the scheduled Service time, no cancellation fee will usually apply. If any non-refundable costs have already been incurred by Waste Clearance Hackney, such as special disposal arrangements, these may be charged to the Customer.
7.3 If the Customer cancels within 24 hours of the scheduled Service time, or if Waste Clearance Hackney attends the Site and is unable to carry out the Service due to lack of access, absence of an authorised person, or other reasons outside our control, a cancellation or call-out fee may be charged to cover time and travel costs.
7.4 Waste Clearance Hackney reserves the right to cancel or reschedule a booking due to vehicle breakdown, staff unavailability, severe weather, safety concerns, access issues beyond our control, or other circumstances that make it impractical or unsafe to carry out the Service. In such cases, Waste Clearance Hackney will offer an alternative time or date. Waste Clearance Hackney will not be liable for any loss arising from such cancellation or rescheduling, other than refunding any pre-paid amounts for Services not provided.
8.1 The Customer must ensure that the Waste presented for collection is correctly described and does not include any prohibited or hazardous items unless specifically agreed in advance and in compliance with relevant regulations.
8.2 The Customer must segregate or clearly identify any items that are not to be removed, and must ensure that valuable or personal items are not mixed with the Waste.
8.3 The Customer is responsible for obtaining any permissions or consents required from property owners, managing agents or neighbours for access and clearance work at the Site.
8.4 The Customer must co-operate with Waste Clearance Hackney operatives and follow any reasonable instructions relating to health and safety, site access or waste handling.
9.1 Waste Clearance Hackney operates in accordance with applicable UK waste management legislation and environmental regulations, including requirements relating to waste carrier registration, duty of care, and appropriate disposal or recycling of collected materials.
9.2 Certain items may be subject to special controls or may be prohibited from collection, including but not limited to asbestos, clinical or medical waste, biohazardous materials, gas cylinders, explosives, corrosive substances, certain chemicals, oils, or electrical and electronic equipment requiring specialist treatment where such services have not been arranged in advance.
9.3 If Waste Clearance Hackney discovers prohibited or hazardous items within the Waste after collection, we may return such items to the Customer or arrange specialist disposal. Any additional costs, fees, fines, or penalties arising from the presence of such items will be the responsibility of the Customer.
9.4 Waste Clearance Hackney will take reasonable steps to ensure that collected Waste is transported to licensed facilities for reuse, recycling, recovery or disposal, and that all legal documentation required for waste transfer is properly completed.
10.1 Ownership of Waste transfers from the Customer to Waste Clearance Hackney at the point the Waste is loaded into our vehicle, subject to any exceptions for prohibited or hazardous materials as set out in these Terms and Conditions.
10.2 Before Waste is loaded, it remains at the Customer's risk. Once the Waste has been loaded, the risk associated with the Waste transfers to Waste Clearance Hackney, except where such Waste has been incorrectly described or includes prohibited items.
11.1 Waste Clearance Hackney will exercise reasonable care and skill in providing the Services. We maintain appropriate insurance cover for our operations, subject to the terms and limitations of those policies.
11.2 Waste Clearance Hackney shall not be liable for any indirect, consequential or economic loss, including loss of profit, loss of business, loss of opportunity or loss of goodwill, arising out of or in connection with the provision of the Services.
11.3 Waste Clearance Hackney's total liability for any loss or damage arising out of or in connection with the Services, whether in contract, tort or otherwise, shall be limited to the amount paid or payable by the Customer for the specific Service during which the loss or damage occurred.
11.4 Waste Clearance Hackney will not be responsible for any loss of or damage to items that the Customer intended to keep but which were not clearly identified as non-waste. The Customer must ensure that valuables, important documents, and items of sentimental or financial value are removed or clearly marked before the Service commences.
11.5 Nothing in these Terms and Conditions shall exclude or limit liability for death or personal injury caused by negligence, fraud, or any other liability which cannot be excluded or limited under applicable law.
12.1 Waste Clearance Hackney will take reasonable care to avoid damage to property when carrying out the Services. However, the Customer acknowledges that the movement of heavy items, large volumes of waste, or work in confined spaces may carry a risk of minor damage.
12.2 The Customer must advise Waste Clearance Hackney of any fragile surfaces, hidden services, or areas of particular sensitivity before the Service begins.
12.3 If any damage is caused directly by the negligence of Waste Clearance Hackney operatives, the Customer must notify Waste Clearance Hackney in writing as soon as reasonably practicable and in any event within 48 hours of completion of the Service. Waste Clearance Hackney may at its discretion repair the damage, arrange for a third party to repair it, or offer reasonable compensation, subject to the overall limitation of liability set out in these Terms and Conditions.
13.1 If the Customer is dissatisfied with any aspect of the Service, they should contact Waste Clearance Hackney as soon as possible, providing full details of the issue, the date of service, and any supporting information.
13.2 Waste Clearance Hackney will investigate complaints in a timely manner and will aim to resolve them amicably. The Customer agrees to give Waste Clearance Hackney a reasonable opportunity to inspect any alleged issues and, where appropriate, to rectify them.
14.1 Waste Clearance Hackney collects and processes personal data of Customers for the purposes of managing bookings, providing Services, issuing invoices and meeting legal obligations. Personal data will be handled in accordance with applicable data protection laws in the UK.
14.2 Customer details will not be sold to third parties. Data may be shared with service providers or authorities only as necessary to fulfil the Services, comply with legal obligations, or protect legitimate interests.
15.1 Waste Clearance Hackney may amend these Terms and Conditions from time to time. The updated version will apply to any new bookings made after the date on which the revised Terms and Conditions come into effect.
15.2 Continued use of our Services after any changes have been notified will be deemed to constitute acceptance of the updated Terms and Conditions.
16.1 These Terms and Conditions and any dispute or claim arising out of or in connection with them, or with the provision of the Services, shall be governed by and construed in accordance with the laws of England and Wales.
16.2 The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Services provided by Waste Clearance Hackney.
17.1 If any provision or part-provision of these Terms and Conditions is found to be invalid, unlawful or unenforceable, it shall be deemed deleted, but that shall not affect the validity or enforceability of the remaining provisions.
18.1 These Terms and Conditions, together with any written quotation or confirmation of booking, constitute the entire agreement between the Customer and Waste Clearance Hackney in relation to the Services, and supersede any prior agreements, understandings or arrangements, whether written or oral.
18.2 No variation of these Terms and Conditions shall be effective unless it is made in writing and agreed by an authorised representative of Waste Clearance Hackney.
